Financially, donation of an asset to our non-profit is also tax deductible. Any company type should be able to make a deduction equal to the write off of expired inventory.


But, there are even better deductions for certain organizations!


The deductibility of an inventory asset, such as a pharmaceutical, to a qualified non-profit organization is governed by Internal Revenue Code Section170(e)(3), which provides for an enhanced charitable deduction primarily for C Corporations. Unlike a typical property donation, where the deduction is limited to the lesser of the asset's basis (cost) or its fair market value (FMV) if the asset would yield ordinary income if sold, 170(e)(3) allows a deduction greater than the cost basis. The allowed deduction is calculated as the sum of: 1) the property's basis, and 2) one-half of the difference between the FMV and the basis. This enhanced deduction, however, is capped at twice the property's basis. To qualify, the property must be used by the donee solely for the care of the ill, the needy, or infants, and the donor must receive a written statement confirming this restricted use.


Example: A pharmaceutical company (C Corporation) donates $1,000 worth of medication (FMV) that has an original cost basis of $400.

  1. Gain: $1,000 (FMV}) - $400 (Basis) = $600

  2. Half-Gain: $600 / 2 = $300

  3. Preliminary Deduction: $400(Basis) + $300 (Half-Gain) = $700

  4. Maximum Deduction Limit (Twice Basis): $400 times 2 = $800


Since the preliminary deduction ($700) does not exceed the maximum limit ($800), the company can claim a $700 tax deduction. This allows the company to deduct more than its cost basis, effectively encouraging the donation of surplus inventory for charitable purposes.
